Immigration Attorney Warns DOJ Denaturalization Push Could Test Legal Safeguards
Jackson Heights, NY (FreePR.org) -- JACKSON HEIGHTS, N.Y. — A newly announced federal effort to revoke the citizenship of hundreds of naturalized Americans is raising concerns among immigration attorneys about transparency, due process, and the potential for overreach.
The U.S. Department of Justice recently indicated it is pursuing denaturalization proceedings against 384 individuals. While federal law permits revoking citizenship obtained through fraud or material misrepresentation, legal experts say the scope and pace of current enforcement efforts merit closer scrutiny.
“Denaturalization is one of the most serious actions the government can take against a citizen,” said Daniel S. Drucker of the Drucker Law Firm, an immigration attorney based in New York. “It’s essential that these cases are handled with clear standards, strong evidence, and full due process protections.”
Under existing law, individuals may be stripped of citizenship if it is proven they concealed disqualifying information — such as prior criminal convictions — or obtained status under false pretenses. A 2017 Department of Homeland Security report found that the digitization of older fingerprint records identified more than 800 cases where individuals allegedly obtained citizenship under alternate identities after prior deportation.
Historically, denaturalization has been used sparingly. Between 1990 and 2025, the federal government initiated approximately 425 such cases. Recent calls for significantly increasing enforcement — reportedly up to 200 cases per month — would mark a sharp escalation.
Legal observers caution that a rapid expansion could strain court resources and extend timelines for resolution. “These are complex federal cases that require extensive investigation and litigation,” Drucker said. “Ramping up volume without additional safeguards and resources could lead to prolonged legal battles and increased pressure on the system.”
Advocates emphasize that transparency in how cases are selected—and ensuring actions are based strictly on evidence of fraud — will be critical to maintaining public trust.
“Citizenship is a cornerstone of legal stability,” Drucker added. “Any effort to revoke it must be applied carefully, consistently, and in accordance with constitutional protections.”
